“We just witnessed power kidnapping the law,” is an act of diagnosis. It’s a declaration that a fundamental line has been crossed. History is filled with such moments, and the response of those who witness it determines whether the law is rescued or whether the ransom is paid indefinitely.

In a healthy society, the law is supposed to be an impartial arbiter. It’s the set of agreed-upon rules that applies to everyone, from the highest official to the most vulnerable citizen. It’s the shield that protects the weak from the strong and the framework that prevents chaos. It is, in essence, a public trust.

This isn’t just any political influence. This is the raw, coercive force of a state, a party, a leader, or a corporation that has the means to impose its will. The kidnapper sees the law not as a public trust, but as a tool or a weapon to be seized and controlled.

This word is crucial. It’s not “influencing,” “persuading,” or “reforming.” Kidnapping implies a violent, illegitimate seizure. The law is being taken from its rightful place—the service of justice—and held hostage to serve the kidnapper’s interests: self-preservation, enrichment, or the silencing of dissent.

What This “Kidnapping” Looks Like in Practice

When power kidnaps the law, it doesn’t always happen with a single, dramatic event. It can be a slow, creeping process. Here are some of the methods:

  1. Weaponizing Institutions: The agencies meant to enforce the law impartially (like the Department of Justice, the police, or the tax authority) are turned against political opponents, activists, and journalists, while allies are granted immunity.
  2. Subverting Legal Processes: This includes extreme gerrymandering to lock in power, passing laws that make it harder for opponents to vote, or changing election rules to ensure a pre-determined outcome.
  3. Creating a “Rule by Law” instead of “Rule of Law”:
    • Rule of Law: Everyone is accountable to the same set of laws.
    • Rule by Law: The law is simply a set of commands issued by the ruler to control the population. The ruler is above the law. The kidnapped law becomes the ruler’s decree.
  4. Packing and Purging the Courts: Filling the highest courts with loyalists who will rubber-stamp the leader’s agenda, regardless of the constitution or legal precedent. Simultaneously, independent judges are removed, disbarred, or intimidated.
  5. Using “Emergency” Powers: Declaring a state of emergency (real or manufactured) to bypass normal legal checks and balances, often with the intention of making those temporary powers permanent.
  6. Controlling the Narrative: The kidnapper insists they aren’t committing a crime at all. They claim they are “restoring order,” “fighting corruption,” or “draining the swamp.” The kidnapping is framed as a rescue mission.
